1. Overview
ExamCert ("we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Title 17, United States Code, Section 512, ExamCert will respond expeditiously to claims of copyright infringement committed on our website (www.examcert.app) and mobile applications (collectively, the "Services") if such claims are submitted to our designated Copyright Agent as described below.
2. Our Commitment to Intellectual Property
ExamCert is committed to protecting intellectual property rights. We take copyright infringement seriously and will:
- Respond promptly to all valid DMCA takedown notices
- Remove or disable access to allegedly infringing material upon receipt of a proper notice
- Notify the content contributor whose material has been removed
- Terminate access for users who are repeat copyright infringers
- Maintain accurate records of all copyright claims and responses
- Cooperate with copyright owners and their agents to resolve disputes
Upon receipt of a notice alleging copyright infringement, ExamCert will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content.
3. User-Contributed Content
ExamCert's practice question database is developed using a combination of original content created by our expert team and user-contributed content from our community of certified professionals. While we make every effort to ensure all content on our platform is original or properly licensed, the nature of user-contributed content means that unauthorized material may occasionally appear on our Services.
We maintain the following safeguards:
- Content Review: All submitted content undergoes review before publication
- Originality Standards: Contributors must affirm that their submissions are original work or properly licensed
- Terms of Submission: Our Terms of Service require contributors to warrant they hold necessary rights to submitted content
- Monitoring: We actively monitor for potential copyright issues and remove content proactively when identified
Despite these measures, if copyrighted material appears on our platform without proper authorization, we encourage rights holders to notify us immediately using the procedure outlined below.
4. Filing a DMCA Takedown Notice
If you believe that your copyrighted work or other intellectual property has been infringed upon by content available through our Services, you may submit a written DMCA takedown notice to our designated Copyright Agent. Your notice must comply with the requirements of 17 U.S.C. § 512(c)(3) as described in Section 5 below.
Before Filing: We encourage you to first consider whether your claim constitutes fair use under 17 U.S.C. § 107. Factors include the purpose of use, nature of the copyrighted work, amount used, and effect on market value. Misrepresentation of a copyright claim may result in liability for damages under 17 U.S.C. § 512(f).
5. Notice Requirements
To be effective, your DMCA takedown notice must be a written communication provided to our designated Copyright Agent that includes all of the following:
- Identification of Copyrighted Work: A description of the copyrighted work or other intellectual property that you claim has been infringed. If multiple copyrighted works are covered by your notice, you may provide a representative list of such works.
- Identification of Infringing Material: A description of where the material that you claim is infringing is located on our Services, with sufficient detail to allow us to find and identify it. Please provide the specific URL(s) or other identifying information for each item of allegedly infringing content.
- Contact Information: Your full legal name, mailing address, telephone number, and email address where we can contact you. If the alleged infringing party is different from you (i.e., a third party uploaded the content), please also provide an email address where the alleged infringing party can contact you.
- Good Faith Statement: A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner, or that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: Your electronic or physical signature (a typed full legal name is acceptable as an electronic signature).
Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure your claim is valid before submitting.
6. How We Process Claims
Upon receiving a valid DMCA takedown notice, ExamCert will follow this process:
6.1 Initial Review
- We will review the notice to ensure it meets all requirements under 17 U.S.C. § 512(c)(3)
- If the notice is incomplete, we may request additional information from the complainant before taking action
- We aim to acknowledge receipt of your notice within 2 business days
6.2 Content Removal
- If the notice is valid and complete, we will promptly remove or disable access to the allegedly infringing material
- Content removal typically occurs within 5 business days of receiving a valid notice
- In urgent cases involving clear infringement, we may expedite removal
6.3 Notification to Content Provider
- We will immediately notify the person responsible for posting the allegedly infringing material that we have removed or disabled access to it
- We may provide the responsible person with your email address so they may respond to your allegations
- The content provider will be informed of their right to submit a counter-notification
6.4 Record Keeping
- We maintain records of all DMCA notices received and actions taken
- Records are retained for a minimum of 3 years for legal compliance
7. Counter-Notification Procedure
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or access was disabled
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, any judicial district in which ExamCert may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person
Upon receipt of a valid counter-notification, ExamCert will:
- Forward the counter-notification to the original complainant
- Inform the complainant that the removed material will be restored in 10-14 business days unless the complainant files a court action
- Restore the material within 10-14 business days after receiving the counter-notification, unless the Copyright Agent receives notice that the original complainant has filed a court action seeking to restrain the content provider from engaging in infringing activity
8. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, ExamCert maintains a policy to terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. ExamCert may also, at its sole discretion, limit access to the Services and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
Our repeat infringer policy includes:
- First Offense: Warning notice and removal of infringing content
- Second Offense: Temporary suspension of content submission privileges and mandatory review of all previously submitted content
- Third Offense: Permanent termination of account and removal of all contributed content
9. Good Faith & Misrepresentation
ExamCert processes DMCA notices in good faith. We expect all parties involved to act honestly and in good faith. Please be aware of the following:
- For Copyright Owners: Filing a false DMCA notice is a serious matter. Under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly materially misrepresent that content is infringing.
- For Content Providers: Filing a false counter-notification is equally serious and may result in legal liability.
- Fair Use Consideration: Before filing a DMCA notice, please consider whether the use of the material constitutes fair use under 17 U.S.C. § 107. Courts have held that copyright holders must consider fair use before issuing takedown notices.
10. DMCA Safe Harbor
ExamCert operates in accordance with the DMCA safe harbor provisions set forth in 17 U.S.C. § 512. As a service provider, ExamCert:
- Does not have actual knowledge that materials on its Services are infringing
- Is not aware of facts or circumstances from which infringing activity is apparent
- Acts expeditiously to remove or disable access to infringing material upon obtaining actual knowledge or awareness
- Does not receive a financial benefit directly attributable to infringing activity where it has the right and ability to control such activity
- Has designated an agent to receive notifications of claimed infringement as described herein

In the event ExamCert removes the allegedly infringing materials, ExamCert will immediately notify the person responsible for posting such materials that ExamCert removed or disabled access to the materials.
Response Time: We aim to acknowledge all DMCA notices within 2 business days and take action within 5 business days of receiving a valid and complete notice.
