You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent.
2. Use of Service
ExamCert provides exam preparation materials, including practice questions, study guides, and educational content for various IT certification exams. Our Services include:

- Progress tracking and performance analytics
- Free and premium content tiers
2.1 Permitted Use
- Access and use practice questions for personal study purposes
- Download and use our mobile applications on your personal devices
- Track your progress and performance within the app
- Access study guides and educational materials
2.2 Prohibited Use
You agree NOT to:
- Copy, modify, distribute, sell, or lease any part of our Services or content
- Reverse engineer, decompile, or extract source code from our applications
- Share your account credentials or premium access with others
- Use automated systems to scrape, crawl, or extract our data
- Use our Services for any commercial purpose without written consent
- Circumvent any security measures or access restrictions
- Share actual exam content from certification exams
- Upload malicious code or interfere with the Services' operation

3. User Accounts
Some features of our Services may require you to create an account or make purchases through the Apple App Store or Google Play Store.

- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You accept responsibility for all activities that occur under your account

- Provide accurate and complete information when creating an account
- Each account is for a single user only - account sharing is prohibited
- You may not create multiple accounts to abuse free trial or promotional offers
4. Payment and Refunds
4.1 Pricing
Premium features are available through a one-time purchase of $4.99 USD (or equivalent in your local currency). This is a lifetime purchase with no recurring subscription fees.
4.2 Payment Processing
- All payments are processed securely through the Apple App Store or Google Play Store
- Prices may vary by region and are subject to applicable taxes
- By making a purchase, you also agree to the respective app store's terms of service
4.3 Refund Policy
To claim a refund under our guarantee:
- Complete at least 90% of all practice questions in the app
- Achieve 85%+ on at least 3 mock exams
- Fail your official exam on the first attempt
- Submit proof of exam failure within 30 days

5. Intellectual Property
All content provided through our Services, including but not limited to practice questions, study guides, explanations, graphics, logos, and software, is the property of ExamCert or our content suppliers and is protected by intellectual property laws.
5.1 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial educational purposes only.
5.2 Restrictions
- You may not copy, modify, distribute, sell, or lease any part of our Services or content without express written permission
- "ExamCert" and our logo are trademarks of ExamCert. You may not use our trademarks without prior written consent
- Any feedback, suggestions, or ideas you submit may be used by ExamCert without any obligation to you

6.2 No Guarantee of Results
Our practice questions are created independently for educational purposes. They are designed to help you prepare for certification exams but:
- Are NOT actual exam questions and should not be considered as such
- Do NOT guarantee you will pass any certification exam
- May not match the exact content, format, or difficulty of actual exams
- Results depend on individual effort, prior knowledge, and exam conditions
6.3 "As Is" Provision
Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- EXAMCERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
- OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR ANY FAILURE TO PASS CERTIFICATION EXAMS, REGARDLESS OF YOUR USE OF OUR SERVICES

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
8. Termination
8.1 Termination by ExamCert
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, for reasons including but not limited to:
- Violation of these Terms of Service
- Fraudulent or illegal activity
- Account sharing or unauthorized distribution of content
- Abuse of our refund policy
- Conduct that harms other users or ExamCert
- Non-payment or payment disputes
8.2 Termination by You
You may stop using our Services at any time. To request account deletion, contact us at [email protected].
8.3 Effect of Termination
- Your right to access the Services will immediately cease
- We may delete your account and associated data
- Provisions that should survive termination (including intellectual property, limitation of liability, disclaimer, and indemnification) will remain in effect
- You will not be entitled to a refund upon termination for cause
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where ExamCert operates, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Services shall be resolved through:
- Informal Resolution: First, by contacting us at [email protected] to attempt to resolve the dispute informally
- Binding Arbitration: If informal resolution fails, through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law
You agree to waive any right to participate in class action lawsuits or class-wide arbitration against ExamCert, to the extent permitted by law.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
